The following General Terms and Conditions of Sale govern the offer and sale, together with the Terms of Use, Returns and Exchanges, the Privacy and Warranty Information for products with the “Il Torchio” trademark on the website www.legatoriailtorchio.com (of following Site).

The Customer is required to carefully read the General Conditions that have been made available to him on the Site, in order to allow them to be stored and reproduced by the Customer pursuant to Legislative Decree 9 April 2003, n. 70, act of transposition into Italian law of Directive 2000/31 / EC “relating to certain legal aspects of information society services, in particular electronic commerce, in the internal market”, Legislative Decree 6 September 2005, n. 206 – Consumer Code, subsequent amendments and additions.

Scope of

The General Conditions of Sale apply and govern all sales contracts concluded through the Seller’s Site, as identified above.
The General Conditions of Sale may be subject to change and each User must consult them before proceeding with any purchase. It is the responsibility of the User to check the General Conditions of Sale before submitting the order.
The Seller is never responsible for the supply of “Il Torchio” branded products by third parties present on the Site through links, banners or hypertext links. Before confirming third party orders, the User is obliged to check the Conditions of Sale.
The General Conditions of Sale apply regardless of the User’s nationality, provided that the delivery of the products must take place in one of the countries for which the Site provides online sales service that the country corresponds to that of registration of the User.
The purchase of products on the Site is reserved exclusively to natural persons acting as consumers and more than 18 years of age.
By consumer is meant any natural person acting for purposes unrelated to commercial, entrepreneurial, craft and professional activity carried out.

Conclusion of the contract

These general conditions of sale are an integral and essential part of the sales contract between the seller and the user.
The electronic transmission by the User implies fully understanding and integrity of the General Conditions of Sale, Use and Privacy Policy. If the user does not agree with one or more terms in the General conditions of sale, please refrain from making purchases on the Website.
The payment of the price of the products included in the cart was accepted to complete the purchase. Orders that are not registered are canceled automatically.
When the User places an order, he will receive an e-mail containing the confirmation of receipt of the order and the summary of the order: this communication will not however constitute automatic acceptance of the order.
The seller reserves the right to refuse orders that are incomplete and incorrect or of users with whom there is a dispute concerning the payment of a previous order. In such cases the user receives an e-mail with the refusal of the motivated order.
If the products presented on the site are no longer available on the site, it is the seller’s responsibility to inform the User, within 5 days from the day following the one on which the order is transmitted, with the unavailability of the ordered product. In case of payment the seller will reimburse the price.
The order form contains a reference to these General Conditions of Sale and the Privacy Notice, as well as a summary of the essential characteristics of each product ordered and the relative price, of the accepted payment methods and of the delivery methods of the purchased products, shipping costs, conditions for exercising the right of withdrawal and the methods and times for returning the products purchased.

Product characteristics

The products offered for sale through the Website are exclusively original bookbinding, stationery and office items under the Il Torchio trademark, present in the online catalogue at the time of the order.
The product catalogue can be updated and modified periodically so the permanence of a product among those available online is not guaranteed.
Each product is presented by a descriptive card containing all the essential characteristics; the images and colors of the products offered for sale may not exactly correspond to the real ones due to the settings of the computer systems used by the User for viewing the Site. The images of the products must therefore be considered indicative and do not affect the normal tolerances of use.

Sale prices

All sales prices of the products indicated on the Website include VAT, if applicable due to the country of delivery of the products and any other applicable sales vat.
Product prices may be subject to updates and variations. The User is required to ascertain the final sale price before submitting the related order. The obvious material error reported in the price on the Site compared to the commonly known price of the selected product entails the Seller’s right not to confirm the shipment and proceed with the immediate refund of the purchase value paid by the User without the latter being able to make exceptions in about.

Terms of payment

For the payment of the price of the products and related shipping and delivery costs, if provided, the User can follow one of the methods indicated in the order form.
In case of payment by credit card, the payment procedure will take place via a secure connection connected directly to the bank that owns the online payment service to which third parties can not have access to it. Delivery methods

The products are delivered, using Express mode through couriers directly to the User at the shipping address specified in the order.
By filling in the registration form in the registration procedure necessary to activate the procedure for the execution of this contract and further communications, the User authorizes the Seller to communicate the personal data to the couriers and / or consignors of trust used for the delivery of the products purchased in order to allow the necessary procedures for their delivery.
The Seller will do its best to fulfill the order transmitted within 5 working days and in any case no later than 30 days starting from the day following the one in which the User has transmitted the order. Delivery times include only business days and do not include holidays.
The Site allows you to request the delivery of the products ordered to an address different from that of the User provided that it is included in the country of residence of the User indicated at login; in any case, it is the User’s responsibility to indicate all the necessary references to the successful delivery.
Expected shipping costs and types may vary depending on the country and shipping methods chosen by the User. These costs and any additional costs are charged to the User. The relative amount will be expressly and separately indicated in the order summary, before the User transmits the order, as well as in the order confirmation e-mail.
Both in Italy and abroad, the delivery procedure provides that, in the absence of the recipient at the time of access of the courier, the person in charge will leave a notice, in order to subsequently complete the shipment, in which the contact details will be indicated the contact to agree on the second delivery. In case of non-agreement for the second delivery the parcel will remain in storage at the courier’s warehouse and it will be the responsibility of the User to collect it. In case of failure to collect within 4 days the package will be returned to the Seller. In this case the contract must be considered terminated pursuant to art. 1456 c.c., with communication of the Seller sent by e-mail to the User and therefore the order will be canceled.
The User can always check the status of their order through the appropriate link by entering the number of their order.

Obligations of the user

It is strictly forbidden for minors to conclude an order on the Site. The data entered at the time of purchase must be exclusively their real personal data and not of third parties, or fantasy. The Seller reserves the right to prosecute any violation or abuse, in the interest and for the protection of all consumers.
The User indemnifies the Seller from any responsibility deriving from the issue of incorrect tax documents due to errors in the data provided by the User, being himself solely responsible for the correct insertion. Upon receipt of the products, the User is required to verify the conformity of the same in relation to the order. In particular, it must pay attention to the correspondence between the number of packages indicated on the letter of the carrier and those delivered and to the integrity of the package. Any anomalies (eg tampering, damage) must be specified in writing directly in the courier transport document and the User must refuse delivery. At the same time, the User is obliged to report the fact to the Seller’s Customer Service through a call to +39 055 2342862 or email to orders@legatoriailtorchio.com. If the User accepts the delivery of damaged, damaged products, it will lose the legal guarantee of conformity of the products.

Responsability

The Seller assumes no responsibility for the disservices due to force majeure such as, for example, accidents, explosions, fires, strikes, earthquakes and other events that prevent in whole or in part, to execute the contract within the agreed time.
The Seller will not be liable to any party or third parties regarding damages, losses and costs incurred as a result of failure to execute the contract for the reasons mentioned above, as the customer is only entitled to the refund of the price paid.
Likewise, the Seller is not responsible for any fraudulent and illegal use that may be made by third parties, credit cards, checks and other means of payment, upon payment of the products. The Seller in fact, at no time during the purchase procedure, is able to know the credit card number of the User who, by opening a protected connection, is transmitted directly to the manager of the banking service.

Right of withdrawal

The User may exercise the right of withdrawal and return the product received, without any penalty and without specifying the reason, in compliance with the terms and methods set out below.
The products must be returned intact, undamaged and provided with the barcode and any other seal that is part of the products; products that are returned incomplete, damaged, deteriorated will not be reimbursed.
The products to be returned must be delivered to the shipper within 14 days from the notice of the User to the Seller of their wish to withdraw from the contract.
The costs of returning the products will be charged to the final customer. After the return of the products, the Seller will make the necessary checks regarding their conformity to the conditions and terms indicated therein.
If the right of withdrawal is correctly exercised, the Seller will refund any amounts already collected by the User for the purchase of products.
Whatever the payment method used by the User, the refund is activated by the Seller as quickly as possible and in any case within 14 days from the date on which the Seller became aware of the right of withdrawal, subject to verification of the correct execution of the same and verification of returned products.
The Seller repays using the same payment method used by the User for the purchase of returned products, even if a virtual and / or disposable credit card has been used. The Seller can not in any way make a refund on a credit card different from the one used for the purchase, except in the case in which the card itself has expired in the meantime or has been stolen: in this case the User may send a e-mail orders@legatoriailtorchio.com to arrange the most appropriate repayment method.

Conformity guarantee

Under the law, the Seller has the obligation to deliver to the User goods that comply with the sales contract and the Seller is liable for any lack of conformity of the existing products at the time of delivery or which occur within two years of delivery.
For the purposes of the validity of the warranty that precedes the User must report to the Vendor the lack of conformity within two months of discovery, under penalty of forfeiture, by contacting Customer Service by calling +39 055 2342862 or email to orders@legatoriailtorchio.com. The complaint must contain an accurate and complete description of the defects and damages.
The Customer Service will inform the User of the instructions for returning the defective product which will be at the Seller’s expense.
The User will have the right to request the termination of the contract and the return of the amount paid or, alternatively, the replacement of the product. In case of slight defect / defect the User will have only the right to replace the product.
In any case, defects of conformity deriving from damage due to accidental or liability of the User for non-compliant use of the product use are excluded from the legal guarantee.

Applicable law

Any dispute concerning the application, execution, interpretation and violation of sales contracts stipulated through the Site is subject to Italian law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. In any case, the rights granted to the Consumer by mandatory provisions of the law in force in the country of residence or domicile of the latter will be maintained.

Changes and updates

The Seller reserves the right to modify the Site, the policies and these General Conditions of Sale at any time to offer new products or services, or comply with legal or regulatory provisions. The User who accesses the Site and submits an order will adhere to the policies and terms of the General Conditions of Sale from time to time in force at the time the order is placed, unless any changes are retroactive in accordance with applicable law. If any of the provisions contained therein is held to be invalid, void or unenforceable, this condition will not affect the validity and effectiveness of the other provisions.
